1.Definitions

In these Terms and Conditions, the following words carry the meanings set out below:

• "Service" — the family communication facilitation sessions, educational workshops and mediation support plans offered by Kithwell as described on this website.
• "User" / "You" — any individual who accesses this website, makes an enquiry or engages with Kithwell's services.
• "We" / "Us" / "Our" — Kithwell, operating from 205 Ekkamai Road, Watthana, Bangkok 10110, Thailand.
• "Content" — all written materials, session frameworks, workshop resources and educational documents made available through the Service.
• "Agreement" — these Terms and Conditions together with our Privacy Policy and Cookie Policy.

2.Acceptance of Terms

By accessing this website or engaging with any of our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

• You must be at least 18 years of age to engage with our services.
• If you are acting on behalf of another person or a family group, you confirm you have their knowledge and consent to do so.
• You confirm you have the legal capacity to enter into this Agreement under Thai law.

3.Service Description

Kithwell provides family communication facilitation and general educational services only. Our three core offerings are:

• Neutral Conversation Sessions — facilitated, impartial conversations to help family members communicate more openly. These sessions do not constitute legal, financial, psychological or any other form of regulated advice.
• Communication Skills Workshops — educational sessions focused on listening practices and everyday interpersonal skills. Purely informational in nature.
• Extended Mediation Support Plan — a structured programme of facilitated conversations and educational materials. Strictly non-advisory; outcomes depend entirely on participants.

Services are available to individuals based in Thailand. We reserve the right to decline enquiries at our discretion and to adjust availability at any time.

4.User Responsibilities

When using this website and our services, you agree to:

• Provide accurate and complete information in any enquiry or booking form.
• Treat facilitators and other participants with courtesy and respect throughout all sessions.
• Understand that our services are educational and facilitative only — not a substitute for professional legal, psychological or financial advice.
• Not record, share or reproduce session content without the prior written consent of all parties involved.
• Not use this website in any manner that could damage, disable or overburden our systems.
• Not attempt to access areas of the website or data that are not intended for public use.

5.Intellectual Property

All content on this website, including workshop frameworks, session guides, written materials, graphics and the Kithwell name and logo, remains the intellectual property of Kithwell or its licensors.

You are granted a limited, non-exclusive, non-transferable licence to access and view the website for personal, non-commercial purposes only. This does not include the right to:

• Copy, reproduce or distribute our materials for commercial use.
• Modify or create derivative works based on our content.
• Present our materials as your own.

6.Payment & Fees

Our current service fees, stated in Thai Baht (฿), are confirmed at the time of booking. Fees are subject to change and the current rate at the time of your enquiry will apply.

• Payment arrangements are confirmed during the booking process.
• Cancellations made with at least 48 hours' notice may be rescheduled at no additional charge, subject to availability.
• No refunds are offered for sessions already attended.
• Kithwell reserves the right to reschedule sessions where facilitators are unavailable.

7.Service-Specific Terms

The following additional terms apply to the delivery of our services:

• Sessions are conducted by trained facilitators and are not a regulated professional service. Participants retain full responsibility for decisions made following any session.
• Kithwell does not make records of session content for third parties. Notes taken during sessions belong to the participants.
• The Extended Mediation Support Plan comprises a defined number of sessions as agreed at the time of booking. Unused sessions within the plan do not carry forward beyond an agreed period.
• We reserve the right to conclude a session early if conduct becomes harmful or disrespectful to any party present.

8.Disclaimers

Our services are offered on an "as available" basis. We make no representations about the suitability of our services for any particular purpose.

• Kithwell does not offer legal, financial, medical or psychological advice. Nothing shared in any session should be construed as such.
• Outcomes of facilitated conversations depend entirely on the willingness and effort of participants. We make no representations about results.
• This website may contain links to third-party sites. We are not responsible for the content or practices of those sites.

9.Limitation of Liability

To the fullest extent permitted by Thai law, Kithwell's total liability for any claim arising from these Terms or the use of our services is limited to the amount paid by you for the specific service giving rise to the claim.

We shall not be liable for any indirect, consequential or special losses, including loss of income, loss of relationships, or any other losses not directly caused by a breach of these Terms on our part.

10.Indemnification

You agree to indemnify and hold harmless Kithwell, its facilitators and associates from any claims, losses or costs arising from your breach of these Terms, your use of our services, or any inaccurate information you provide during the booking or session process.

11.Termination

Either party may bring the service relationship to an end at any time by providing reasonable notice. Kithwell reserves the right to immediately discontinue services where:

• A participant's conduct is harmful, threatening or disrespectful.
• Continuing the service would conflict with legal or ethical obligations.

Upon termination, clauses relating to intellectual property, disclaimers and liability continue in effect.

12.Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of the Kingdom of Thailand. Any disputes arising from this Agreement shall fall under the jurisdiction of the courts of Bangkok, Thailand.

13.General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, form the complete agreement between you and Kithwell.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not transfer your rights or obligations under these Terms to another party without our written consent.

14.Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. We will update the "Last Updated" date at the top of this page when we do so.
